1. GENERAL RULES
1.1. These rules (the Rules) apply to the usage by you of the services provided via the website www.tonybet.com (the Website) and other related URLs.
The Website is operated as follows:
Betting and online casino on the Website is operated by Tonybet OÜ, registered at Tammsaare tee 102-39, Tallinn 12319, Estonia under betting and online casino licenses issued by the Estonian Tax and Customs Board (EMTA).
The operations of Tonybet OÜ (hereinafter referred to as Tonybet) on the Website are regulated by EMTA. EMTA is a Estonian government body responsible for the supervision of gaming activities. It handles the administration of all tasks relating to gaming activities. Tonybet is a licensed member and is reviewed by EMTA continuously.
1.2. When opening an account with Tonybet the Rules need to be accepted and respected and the acceptance of the Rules by you constitutes a binding agreement between you and Tonybet. It is the responsibility of the customer to know the Rules and to abide by them at all times.
The Rules are governed by and construed in accordance with the laws of Estonia. In case of any disputes arising out of or in connection with the Rules or any service provided hereunder the laws of Estonia shall apply.
1.3. The Rules are published in a number of languages for information purposes and ease of access by players. It is only the Estonian version that is the legal basis of the relationship between you and Tonybet and in case of any discrepancy between a non-Estonian version and the Estonian version of these Rules, the Estonian version shall prevail.
1.4. When opening an account with Tonybet, a person should only use his or her true full name. A customer account can only be opened by the customer and will remain open as long as the account is not closed by the customer or Tonybet. Should the customer wish to close his/her account, he/she should send a respective request to Tonybet.
1.5. An account with Tonybet is personal and only the owner of the account has the right to log in to the account. Tonybet is not responsible if a customer's account is abused by a third party. The customer must keep the user name and password confidential and not permit any other person to have access to this information. Any bets placed using the correct security details will be debited from the customer’s account. In the event a customer suspects that the user name and password have become available to any other person, the customer must communicate this to Tonybet immediately. New security details will then be issued to the customer. You may not make bets on behalf of others. Tonybet reserves the right to cancel any bet made by a third party.
1.6. You are responsible for providing correct personal and contact information (name, address, phone number, e-mail address, etc.) and updating the same from time to time. Tonybet reserves the right to request further information, even after registration of a Tonybet account, in order to avoid the abuse of the same account, a credit card, a bank or e-wallet account, etc.
You must enter all mandatory information requested into your registration form. In particular, your name, address, ID number (or similar identification number) and other contact details such as e-mail address, place of residence, relevant payment information Tonybet all be true and correct. It is your sole responsibility to ensure that the information you provide is true, complete and correct and you hereby warrant to Tonybet that the information provided is true, complete and correct. You are hereby notified that Tonybet carries out verification procedures, whether itself or through third parties on players registering a Tonybet account. You may be requested to provide Tonybet with further documents. Your Tonybet account may be blocked or closed if you do not provide requested information or documents or if such information or documents you supply are found false or misleading.
1.7. To become a customer with Tonybet you need to be at least 21 years old (where applicable - 18 years to participate in online casino).
Upon discovery that an account has been opened by a person under age, any winnings will be confiscated, deposit or remaining balance, as the case may be, returned (subject to reasonable charges) and the account will be closed.
1.8. We reserve the right to decline a new customer or close an account without having to give a reason for doing so.
1.9. A customer is allowed to have only one Tonybet account. If you try to open more than one Tonybet account, all accounts you try to open may be blocked or closed. If a customer has used more than one account to avoid the Rules and/or exceed applicable limits, we reserve the right to cancel any bets exceeding these limits, including the right to reduce the customer’s betting limits. In the event of a repeat violation, the entire wager amount might be refunded.
1.10. Tonybet has a right to forbid that different account holders from the same household and/or family are betting on the same object, including the use of the same object in different combinations, to avoid the Rules and/or exceed applicable limits.
1.11. Tonybet prohibits player collusion and takes active measures in prohibiting any use of robots or other devices that distort the normal game. Tonybet does not accept bets when it is likely that customers are acting in agreement, or as a syndicate. When syndicated bets are discovered, we reserve the right to cancel these bets.
1.12. Fraud or attempts to commit fraud or violation of the Rules may lead to reduction of betting limits, closing of accounts, confiscation of winnings, return of deposits or remaining balance, as the case may be (subject to reasonable charges), and/or cancellation of all placed bets (even decided bets). Tonybet also reserves the right to take legal action against the customer or customers involved in such fraudulent behavior.
1.13. The customer has the responsibility to ensure that the customer complies with all laws in any jurisdiction that apply to the customer’s use of Tonybet’s service. If the customer lives in a country where remote gambling is prohibited the customer must neither register with Tonybet nor attempt to use Tonybet’s services. Remote gambling may be illegal in the jurisdiction in which the customer is located, and if so, the customer is not authorized to use the services of Tonybet.
1.14. The service provided by tonybet is provided “as is” without any express or implied warranty of any kind including warranties of merchantability, non-infringement of intellectual property, or fitness for any particular purpose. In no event shall tonybet be liable for any damages whatsoever (including, without limitation, damages for loss of direct or indirect profits, economic loss, business interruption, loss of information) or any direct, indirect, consequential or special losses howsoever caused including but not limited to any loss of contracts, loss of goodwill, and loss of reputation arising out of the use of or inability to use the tonybet service, even if tonybet has been advised of the possibility of such damages. Because some jurisdictions prohibit the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
1.15. If and only to the extent that Clause 1.14 does not apply to the customer, the maximum liability of Tonybet to the same customer shall be limited to the average balance held in the customer’s account with Tonybet in the previous six months.
1.16. Tonybet is not liable for any loss of damage that the customer may suffer because of any act of God, power failure, trade or labor dispute, act, failure or omission of any government or authority, obstruction or failure of telecommunication services or networks, or any other delay or failure caused by a third party. In such an event Tonybet reserves the right to cancel or suspend the services without incurring any liability. Tonybet is not liable for the failure of any equipment or software, wherever located or administered, or whether under Tonybet’s direct control or not, that may prevent the operation of the gambling services, impede the placing of orders for bets or the matching of bets or prevent the customer from being able to contact Tonybet.
1.17. The customer agrees to indemnify and hold Tonybet and its subsidiaries, affiliates, officers, directors, agents and employees harmless from any liabilities, claims, losses or demands made by any third party arising out of the customer’s breach of these Rules including documents incorporated by reference into these Rules or out of the customer’s violation of any law or the rights of any third party.
1.18.1. You hereby acknowledge and consent to Tonybet processing of your personal data for the purposes of allowing you to access and use the Website and to provide ancillary services to you.
1.18.2. Tonybet is bound by the Estonian Data Protection Act and shall process your personal data in accordance with the said laws. Moreover, Tonybet will protect your personal information and respect your privacy in accordance with best business practices and applicable laws.
1.18.3. Tonybet will only use your personal data to allow you to use the services provided on the Website.
1.18.4. Tonybet shall also process your personal data for the purposes of carrying out verification procedures in relation to your use of the services provided on the Website.
1.18.5. Your personal data will not be disclosed to third parties, unless such disclosure is necessary for processing of your requests, such as effecting transactions on your Tonybet account, to carry verification procedures or unless it is required by law. As Tonybet’s business partners or suppliers or service providers may be responsible for certain parts of the overall functioning or operation of the Website, personal data may be disclosed to them. You hereby consent to all such disclosures.
1.18.6. You have the right to access personal data held by Tonybet about you. Furthermore, you have the right to access information about your account balance, gaming history, deposits, withdrawals and other transaction data related thereto from the day your account has been opened.
1.18.7. You hereby consent that Tonybet may hold and store your personal data (including transaction data) even after your Tonybet account is closed or terminated to the extent required by Estonian law.
1.18.8. You promptly inform Tonybet, by amending your profile or otherwise, of any changes to information provided by you at the time of registration and opening of your Tonybet account.
1.18.9. In order to provide you with an efficient service, Tonybet and/or its service providers may be required to transfer your personal data from one country to another on worldwide basis. You hereby consent to your personal data being so transferred.
1.18.10. In the processing of your Tonybet account and associated transactions, Tonybet may have recourse to credit rating agencies, fraud detection agencies, anti-money laundering agencies who may keep a record of your information. You hereby consent to such disclosures.
1.18.11 Notwithstanding the above, Tonybet may publish details about specific winnings of individual players on the Website. Such publications will include the username or the relevant player and the amount won, and you hereby agree and approve of such publications on the Website.
1.18.12. In order to make your visit to the Websites more user-friendly, to keep track of visits to the Websites and to improve the service, Tonybet collects a small piece of information sent from your browser, called a cookie. You can, if you wish, turn off the collection of cookies (please refer to your browser instructions as to how to do this). Tonybet notes, however, that turning off cookies may restrict your use of the Website.
1.18.13. You consent to Tonybet informing you from time to time about changes on the Website, new services and promotions. If you do not wish to receive direct marketing data you may opt out of such service. You can opt in again into receiving promotional material by emailing our support department.
1.19. The customer’s sole remedy in the event of the closure of the customer’s account by Tonybet for any reason shall be the reimbursement of any undisputed account balance he/she may then have, and Tonybet shall have no further liability to the customer whatsoever.
1.20. Tonybet is the owner or authorized user or licensee of all the intellectual property rights in the Website and its content including, without limitation, any copyright, patent, registered design, trademarks, service marks, source codes, specifications, templates, graphics, logos, or any rights subsisting in Estonia or elsewhere in respect of content, databases, formats, interfaces, programming, the offering of services to other customers, software or any application for any of the foregoing and any modification, improvements, developments and enhancements thereof. Except as otherwise expressly provided in these Rules, Tonybet does not grant any express or implied right to the customer in any intellectual property rights or secret information held on Tonybet’s servers.
1.21. Tonybet reserves the right to amend these Rules at any time. Any such amendment will be binding and effective immediately on posting of notification of such changes on the Website, however, any substantial amendment to these Rules shall be notified in advance by Tonybet to the customer before coming into effect.
1.22. If any provision of these Rules is held to be invalid, void or unenforceable by reason of any law, rule, administrative order or judicial decision, that determination shall not affect the validity of the remaining provisions of the Rules.
1.23. Notices and other communications delivered or mailed to the postal address or to the electronic mail address provided by the customer shall, until Tonybet has received notice in writing of any different address, be deemed to have been personally delivered once sent whether actually received or not.
1.24. Under certain circumstances we may require verification of identity and/or address in order for us to comply with the statutory requirements.
If the customer is requested to furnish any verification of identity, Tonybet requires that the documentation to be supplied by the customer is certified as a true copy of such document and that the photograph in any passport, national identity card or driving license is a true likeness of the customer. Such certification would need to be undertaken by a Notary Public.
1.25. Upon any indication of transactions and/or activities indicating potential money laundering we shall report the same to the relevant authorities.
1.26. Handling of funds in gambling accounts which are no longer being used:
1.26.1. Suspended accounts. A suspended account is an account the access of which is blocked for the user. In case the customer’s Tonybet account has been suspended due to the breach of Rules by the customer, Tonybet shall return the balance of the account to the customer. In case the balance is higher than the deposits made by the customer, Tonybet shall only return the deposits to the customer.
1.26.2. Accounts of self-excluded persons. An account of self-excluded person is an account the owner of which has self-excluded himself/ herself in accordance with Rule 1.27. The owner of an account of self-excluded person must notify Tonybet of the fact that he/ she has self-excluded himself/ herself and as soon as Tonybet has received the notification from the customer, Tonybet shall return the balance of the account to the customer.
1.26.3. Inactive accounts. An inactive account is an account that has been ‘inactive’ for a consecutive period of at least 6 months, that has a real money balance. An account is deemed to be ‘inactive” during any period in which none of the following actions take place in relation to it: (a) a successful deposit; (b) a Sports bet is placed; or (c) participation in any Casino, Live Casino, Live Games Poker, Games, or any other Game provided by TonyBet. If your account remains dormant, after a minimum period of 30 days following Operator’s first attempt to notify you that your account has become dormant, Operator shall deduct a monthly Administration Fee from your account balance of €3 (or currency equivalent) at the time that it is deemed to be dormant. Operator shall use reasonable efforts to contact you.
1.26.4. Accounts with unfinished games. In case there’s an unfinished game on the suspended account or the account of self-excluded person, the customer has the obligation to contact Tonybet and request the payment of the outstanding balance once the game has been settled, unless Rule 1.26.1 applies.
1.27.1. You may at any time, at your discretion, choose to exclude yourself from using any services provided on the Website by following these instructions. Such exclusion can be made either permanently or temporary. During the exclusion period, you will not be able to open or use your Tonybet account.
1.27.2. Permanent Exclusion:
Upon a permanent exclusion, your Tonybet account will be closed and your registration terminated. You will not be able to re-register as a customer of Tonybet until one (1) year has passed since your Tonybet account was closed.
1.27.3. Temporary Exclusion:
Upon a temporary exclusion, you may choose to exclude yourself, and block your Tonybet account, for any of the following periods: 24 hours or any time period exceeding one calendar month. You may choose to exclude yourself directly on the Website for any of the following pre-set time periods: 24 hours, 1 week, 1 month, 3 months, 6 months or 1 year. You may also contact our support service to choose any other exclusion time period exceeding one month.
1.27.4. You have the opportunity to be included in the national register of the Estonian gambling Authority, whereby you will be blocked and excluded from all websites of the licensed operators in Estonia during the relevant time period of the exclusion.
1.27.5. You may at anytime determine your one deposit limits based on a maximum daily, weekly or monthly deposit limit. A request to increase an existing deposit limit will not be affected until 7 days after the relevant request is made.
1.27.6. When setting up your Tonybet account you may choose to impose a ceiling on the maximum losses you may make. The limit will block deposits if the net deposit limit (deposits-withdrawals) has been exceeded for the selected time period. In addition to the preceding we offer additional limitation measures that can be found on My Account page.
1.28.1. If you have a complaint, you can email customer support on [email protected]
1.28.2. Tonybet will use best efforts to resolve a reported matter promptly.
1.28.3. If you have a query with regard to any transaction, you may also contact Tonybet at [email protected] with details of the query. We will review any queried or disputed transactions. Our judgement is final.
1.29. Tonybet strives to ensure the full protection of all its clients and their bets; however, there are certain events that are beyond our control. If, for any reason, the customer is disconnected from the game server, Tonybet cannot be held liable for any losses that may result from this disconnection. Tonybet will undertake best endeavors in ensuring that the balance of customer’s account is recorded on the server and is not affected by the disconnection in any way. If a line has been disconnected or become unresponsive, when the customer logs on the balance of credits recorded on the server after the last bet was completed, is displayed. By placing any further wagers, the customer accepts the results of any previous wager. As such, at Tonybet’s discretion, the results of the previous wager are no longer in dispute and no refunds or other adjustments will be granted. If the customer feels the result of any of the games is unfair or incorrect, they should contact the customer support immediately and report the discrepancy.
1.30. The customer acknowledges and agrees that he/she shall not treat Tonybet as a financial institution nor expect interest on their deposits or winnings, i.e. the customer will not receive any interest on the balance in their customer accounts.
2. DEPOSITS AND WITHDRAWALS
2.1. All deposits and withdrawals will be initiated from your account overview on the Website.
2.2. All information required to deposit funds into your Tonybet account, can be found under “My Account” and “Deposit” pages of the Website. You can use any of the methods available to you as specified in these pages as may be amended from time to time. Please note that some of the methods may not be available in some countries. Any funds deposited Tonybet be utilized for the placing of bets.
2.3. A customer may only make deposits to their own Tonybet account, and only with a credit card issued or from a bank account or e-wallet account held in their own name. It is unlawful to deposit money to your Tonybet account from ill-gotten means. All transactions on your customer account are checked to prevent money laundering, whereas suspicious transactions will be reported to the relevant competent authorities and may lead to freezing of the funds as well as closure of the accounts and confiscation of funds.
2.4. In regards to transfers to and from the sportsbook account from other game accounts, Tonybet reserves the right to manually correct, without further notice to the customer, any transactions that may be regarded as speculation in currency fluctuations.
2.5. It is not possible to transfer money from one Tonybet account to another Tonybet account.
2.6. All winnings will be credited to the customer’s Tonybet account. Withdrawals from the Tonybet account, in the extent of the original deposit amount, are made using the same payment method as was used for the original deposit. For instance, if a deposit was made with a credit card, an amount from the winnings corresponding to the original deposit amount will be withdrawn to the same credit card whereas the remaining winnings amount may be withdrawn by using any other payment method.
Withdrawals will only be made to a credit card issued to, or to a bank account or e-wallet account held in, the customer’s own name. In carrying out withdrawal requests, Tonybet reserves the right to demand official identification documents in accordance with rule 1.25 for purposes of prevention of fraud and money-laundering.
To avoid unnecessary delays in carrying out withdrawal requests, we are dependent on the customer providing us with complete and correct information.
2.7. We reserve the right to apply minimum withdrawal amounts for different payout methods as notified to customers from time to time in the Website.
If a customer requests that an amount smaller than the minimum withdrawal amount be paid out, we may charge the customer a discretionary fee for the same depending on the payout method.
We reserve the right to limit the number of free payouts per customer within a specific time period determined by us.
We also reserve the right to charge a fee for payouts to bank.
2.8. We do not allow bets on credit and Tonybet shall not give you any credit whatsoever. However, if a result is registered incorrectly and a customer’s account is credited erroneously, we reserve the right to debit the customer account accordingly. In the event the account holds a negative balance after corrected result (i.e. the customer has made bets with this money), the customer is obligated to repay the amount erroneously received.
2.9. Monies on a customer’s Tonybet account are held in the name of Tonybet OU.
Terms & Conditions for bonuses:
2.10. Any offer received by a customer from Tonybet is personal and valid only for the particular customer unless stated otherwise.
Any bonus offer from Tonybet is valid only one time per customer account, computer household, IP address and other places with a shared computer (office, library, university, etc.).
All winnings originating from a bonus offer are to be considered bonus winnings and no payout of such winnings will be made until the terms and conditions for the bonus are met.
Unless specified otherwise herein or in bonus offer, the customer’s own deposit must be wagered first, and only then the bonus; if the wager requirement is not fulfilled within 60 days of receiving the bonus, Tonybet reserves the right to withdraw the bonus amount (incl. winnings originating from bonus) from the customer's account.
A bonus offer cannot be used in combination with any other offer for the opening of a new account.
If you wish to have removed any bonus credited to you please contact player support before wagering any such funds including any deposit connected to the bonus.
Tonybet reserves the right to void any bonuses and/or winnings obtained by fraudulent behavior, including the right to deny cash out requests if we suspect that the bonus offer has been abused.
In the event of any disputes regarding bonuses, Tonybet decision is final and binding in all cases.
If these Rules or the terms and conditions of the offer are breached or there is evidence that a customer or a group of customers has made a series of bets that, due to a bonus, increased earnings, free bets or other offers, guarantees a profit for the client, whether individually or part of a group, no matter what the results, Tonybet reserves the right to withdraw the bonus portion of the offers and to settle the bets at the correct odds, or to cancel the free bets and the bets made from deposit bonuses. Tonybet also reserves the right to take legal action against the customer or customers involved in such fraudulent behavior.
3. GENERAL BETTING RULES
3.1. Claims and protests on decisions regarding bets will have to be mailed us within 14 days after the object's original starting time. Unless we receive the complaints within this time limit, they will be denied. Claims and protests can be mailed to [email protected]
3.2 It is not possible to withdraw a bet. Therefore it is important that you carefully survey your bet before you confirm it. Each bet will be given an individual number as confirmation of the transaction. However, bets will be valid, subject to meeting the criteria for placing of bets laid down in these terms and conditions, if accepted by the Tonybet transaction server, whether or not the customer receives the transaction code. Tonybet is not liable for the settlement of any bets where Tonybet has not issued a written confirmation of acceptance of the bet or where Tonybet is unable to display that bet in the "my account" pages of the Website.
3.3. We reserve the right to refuse to accept any bet. An already accepted bet can be cancelled if it does not comply with the Rules or if there is an obvious misprint from our point. In such circumstances a bet can even be cancelled after the result has been confirmed.
It is against the Rules to make bets on the same match in identical or different combinations to transcend our limits.
If a bet is being cancelled, we will do our best to inform you of the reasons why, either through e-mail or on our web page.
3.4. We offer single bets on all our gaming objects, and the odds are guaranteed once you confirm the bet. However, we reserve the right to change the odds on the objects being offered. Of course you keep the odds on your confirmed bet even if a change will be made later on.
3.5. The maximum number of objects permitted in a parlay is thirty (30).
3.6. The maximum betting amount may vary between different kinds of gaming objects. The maximum betting amount on individual gaming objects can be reduced as bets are being made.
The minimum betting amount is 1,00 EUR.
3.7. There will be limits on winnings at different levels. The amounts are independent from betting amounts and odds. If a confirmed bets betting amount is exceeding these standards, we will reduce the betting amount.
3.8. If there are more winners in an event, the odds will be divided between the number of winners. However, the odds will not be lower than 1.0.
3.9. Bets on non-starting participants will not be refunded unless stated otherwise.
3.10. We do not accept parlays where two or more objects will affect each other. Even if the customer by mistake will have such a bet accepted, we will cancel such bets afterwards. In such circumstances bets can also be cancelled after the result has been registered.
When cancelling these bets, the whole bet will be cancelled, even if parts of them are valid.
3.11. We reserve the right to cancel any bets from customers who place money on an event where they are involved as participants, referee, coach, etc.
3.12. If a match is suspected of unfair play, Tonybet reserves to keep any payments on hold. If the unfair play can be verified, Tonybet has the right to cancel the bets.
3.13. Normally bets are open until the official starting time of the event. Sometimes an event starts earlier than first posted, with us being unaware of it, or that we have the wrong starting time. Any bets received after the event has started will be cancelled.
3.14. In the event of a dispute over the time at which a bet was placed and the time at which it was recorded on the transactional log will be agreed as the time at which the bet was placed. The customer must check the account balance each time the customer logs on to the Tonybet Website. In the event of a query, it is the customer’s responsibility to notify Tonybet at the earliest opportunity together with the customer’s record of transactions since the customer’s balance was last verified.
3.15. If a match/event is postponed by more than 12 hours from its original starting time, all bets on that match/event will be void and the stake will be refunded to your account.
If a match/event is interrupted without an official result, the stake will be refunded unless the match/event is resumed within 12 hours of the original starting time. If there is an official result within 12 hours of original starting time all placed bets will stand.
The rule above does not include tennis. Bets on tennis matches will only be cancelled if the match is not completed before the tournament is over.
